AFFILIATE PROGRAM TERMS AND CONDITIONS

These Affiliate Program Terms and Conditions (the "Affiliate Terms") govern your participation in the FxBacktest affiliate program (the "Program"). They are entered into between you ("Affiliate", "you") and FX BACKTEST ("Company", "we", "us", or "our"), a company registered in Bulgaria at Napreduk 14, Belozem, Plovdiv 4130, Bulgaria. By enrolling in or participating in the Program, you agree to these Affiliate Terms, our Terms and Conditions, and our Privacy Policy. If you do not agree, do not join the Program.

1. Eligibility

You must be at least 18 years old and legally able to enter into a binding contract. The Program is administered through our third-party affiliate platform, PromoteKit, and is also subject to its terms. We may accept or decline any application at our sole discretion. You are responsible for ensuring your participation complies with all laws that apply to you, including tax, advertising, and consumer-protection laws.

2. Enrolment & account

To participate you must register for an affiliate account and receive a unique referral link. You are responsible for the accuracy of your account details, the security of your login, and all activity under your account. One person or entity may hold only one affiliate account unless we agree otherwise in writing.

3. Commission

• We pay a commission of 30% of the net amount actually received by us (excluding taxes, fees, refunds, and chargebacks) for each qualifying paid subscription or purchase made by a customer you refer.
• For recurring subscriptions, commission is paid on qualifying renewal payments for as long as the referred customer remains continuously subscribed and the Program remains in effect, subject to these Affiliate Terms.
• Yearly plans and one-time (lifetime) purchases also earn 30%, calculated on the amount charged for that plan.
• Commission is earned only on genuine, first-time customers who were not already registered, subscribed, or in an active checkout with us before clicking your referral link.
• Free-plan signups, free trials that never convert to a paid charge, and internal/test accounts do not generate commission.
• We may change the commission rate or structure on a going-forward basis as described in Section 11.

4. Referral tracking & cookies

Referrals are tracked when a visitor arrives through your referral link and a tracking cookie is set in their browser. A referral is attributed to you if the customer completes a qualifying purchase within the cookie window configured in our affiliate platform (currently 60 days from the last click), subject to last-click attribution. Tracking depends on the customer's browser accepting cookies and not clearing them, and on the referral information being passed through checkout; we are not liable for referrals that cannot be tracked for reasons outside our reasonable control. Where the same customer is referred by more than one affiliate, the most recent qualifying referral is credited.

5. Payments

• Commissions are recorded in your affiliate dashboard and become payable after any applicable hold/clearance period that covers refunds and chargebacks.
• Payouts are made through the methods offered by our affiliate platform (currently PayPal) once your available balance meets the minimum payout threshold shown in your dashboard.
• Payments are made in the currency supported by the platform. You are responsible for any conversion costs and for all taxes arising from your commissions. You may be required to provide valid tax and payment details before we can pay you.
• You are an independent contractor. Nothing in these Affiliate Terms creates an employment, agency, partnership, or joint-venture relationship.

6. Refunds, chargebacks & clawbacks

If a referred payment is later refunded, reversed, charged back, or found to be fraudulent, the associated commission is cancelled. We may deduct (claw back) any commission already credited or paid for such payments from your current or future balance. Commissions on subscriptions that are cancelled stop accruing from the next unpaid billing period.

7. Prohibited practices

You must not:

• Refer yourself, purchase through your own link, or arrange for others to do so on your behalf to generate commission ("self-referral").
• Use spam, unsolicited email, or any messaging that violates anti-spam or privacy laws.
• Bid on our brand names, trademarks, misspellings, or "fxbacktest" variations in paid search, or run ads that impersonate us or send traffic to our domain via your own paid ads without written permission.
• Make false, misleading, or exaggerated claims about the Services, or make income, profit, or financial-return promises on our behalf.
• Use cookie stuffing, forced clicks, iframes, malware, bots, fake traffic, or any technique that fraudulently generates clicks or referrals.
• Post the referral link on coupon, cashback, or "deal" sites, or offer unauthorised rebates from your commission, except where we approve it in writing.
• Promote the Services in a way that is unlawful, deceptive, defamatory, obscene, or that damages our reputation.

Breach of this Section may result in forfeiture of commissions and immediate termination.

8. Advertising & disclosure

You must clearly and conspicuously disclose your affiliate relationship with us wherever you promote the Services, in line with applicable advertising rules (for example the FTC Endorsement Guides and equivalent local laws). Because FxBacktest relates to trading, you must not present it as investment advice or guarantee any trading outcome, and you should reflect that trading involves risk and that past performance does not guarantee future results.

9. Use of our brand

We grant you a limited, non-exclusive, revocable, non-transferable licence to use our name, logo, and approved marketing materials solely to promote the Services under these Affiliate Terms. You must not modify our marks, register domains or social handles containing our marks, or imply that you are us or that we endorse you beyond the affiliate relationship. All goodwill from your use of our marks belongs to us. This licence ends when your participation ends.

10. Term & termination

These Affiliate Terms apply while you participate in the Program. Either party may terminate at any time, for any reason, with or without notice. On termination you must stop using our marks and referral links. We may withhold or cancel unpaid commissions if you breach these Affiliate Terms or engage in fraud. Sections that by their nature should survive termination (including Sections 6, 7, 9, 12, 13, and 14) will survive.

11. Changes to the Program

We may modify, suspend, or discontinue the Program, or update these Affiliate Terms, including the commission rate, cookie window, payout thresholds, and payment methods, at any time. Changes apply on a going-forward basis from the date they are posted. Your continued participation after changes are posted constitutes acceptance.

12. No income guarantee

Any earnings figures, calculators, or examples we provide (including the earnings calculator on the affiliate page) are illustrative only and are not a promise or guarantee of income. Your actual earnings depend on your own efforts, your audience, and how many referred customers subscribe and remain subscribed.

13. Limitation of liability

To the maximum extent permitted by law, the Program and all related materials are provided "as is" without warranties of any kind. We are not liable for any indirect, incidental, special, or consequential damages, or for lost profits or referrals, arising from the Program. Our total liability under these Affiliate Terms will not exceed the total commissions payable to you in the three (3) months before the event giving rise to the claim.

14. Governing law

These Affiliate Terms are governed by the laws of Bulgaria, without regard to conflict-of-law rules, and the courts of Bulgaria will have jurisdiction, except where mandatory local consumer law provides otherwise.
