We are FX BACKTEST ("Company", "we", "us", or "our"), a company registered in Bulgaria at Napreduk 14, Belozem, Plovdiv 4130, Bulgaria.

We operate the website https://www.fxbacktest.app and related products and services that refer or link to these legal terms (collectively, the "Services").

The Services provide a high-performance backtesting engine to validate trading strategies across equities, crypto, and forex using historical data before you risk real capital.

By accessing or using the Services, you agree that you have read, understood, and agreed to be bound by these Legal Terms. If you do not agree with all of these Legal Terms, you are expressly prohibited from using the Services and must discontinue use immediately.

The Services are intended for users who are at least 18 years old. Persons under 18 are not permitted to use or register for the Services.

The information provided when using the Services is not intended for distribution to or use by any person or entity where such distribution or use would be contrary to law or regulation. Users who access the Services from other locations do so on their own initiative and are responsible for compliance with local laws.

We own or license all intellectual property rights in our Services, including source code, databases, functionality, software, website designs, text, graphics, and logos. The Services are provided for your personal, non-commercial use only.

No part of the Services may be copied, reproduced, republished, uploaded, posted, publicly displayed, translated, transmitted, distributed, sold, licensed, or otherwise exploited for any commercial purpose without our prior written permission.

By using the Services, you represent that all registration information you submit is true, accurate, current, and complete; that you have the legal capacity to comply with these terms; that you are not a minor; that you will not access the Services through automated or non-human means; and that your use will not violate applicable law.

You may be required to register to use the Services. You agree to keep your password confidential and are responsible for all use of your account and password. We may remove, reclaim, or change a username if we determine it is inappropriate, obscene, or otherwise objectionable.

We accept Visa, Mastercard, and American Express. You agree to provide current, complete, and accurate purchase and account information for all purchases made via the Services. Payments are charged in Euros. We may change prices at any time and reserve the right to correct pricing errors.

Your subscription will continue and automatically renew unless cancelled. You consent to recurring charges until cancellation. Billing cycles are monthly unless otherwise stated at checkout. A first Pro subscription includes a 7-day free trial. A valid payment method is required to start the trial, no charge is made during the trial period, and the first charge is taken automatically at the end of the 7 days unless you cancel before then. You may cancel at any time during the trial and you will not be charged. The trial is available once per account and is not offered on accounts that previously received a complimentary Pro period. Some accounts registered before 18 August 2026 instead received Pro-tier features free for their first 10 days after registration; no payment method was required for that period and it created no subscription or obligation to pay. The one-time purchase option, where offered, is available only during the first 17 days after registration.

You may request a full refund of any purchase within 14 days of the date it was charged, for any reason. To request a refund, contact us using the details in section 24 below; we will refund to the original payment method. Refund requests made more than 14 days after the charge are considered at our discretion. Nothing in this section affects any statutory cancellation or withdrawal right you have under the law of your country of residence. You can cancel your subscription at any time by logging into your account. Cancellation takes effect at the end of the current paid term, and you keep access until then.

You may not use the Services for any purpose other than that for which we make them available. You agree not to:

• Systematically retrieve data or content to create or compile a collection, compilation, database, or directory without written permission.
• Trick, defraud, mislead, harass, abuse, threaten, or harm us or other users.
• Circumvent or interfere with security-related features or access restrictions.
• Upload viruses, spam, or other material that disrupts the Services.
• Use data mining, robots, scripts, scrapers, or similar extraction tools.
• Copy, adapt, decipher, decompile, disassemble, or reverse engineer any part of the Services except as permitted by law.
• Use the Services to compete with us, sell your profile, or advertise goods and services without authorisation.

The Services may allow you to submit or post content. You are solely responsible for your submissions and contributions. You warrant that your contributions do not infringe third-party rights, violate law, contain false or misleading information, include offensive material, or otherwise violate these Legal Terms.

By posting contributions, you grant us a worldwide, royalty-free, transferable licence to host, use, reproduce, display, distribute, and prepare derivative works from those contributions for purposes connected with the Services. We may remove or edit contributions at any time.

The Services may contain links to third-party websites or content. We are not responsible for third-party websites, content, accuracy, privacy practices, or purchases you make through third parties.

We reserve the right, but not the obligation, to monitor the Services for violations, take legal action, restrict or disable access to content, remove burdensome files, and otherwise manage the Services to protect our rights and property.

Please review our Privacy Policy at https://fxbacktest.app/privacy-policy/. By using the Services, you agree to be bound by the Privacy Policy, which is incorporated into these Legal Terms.

We respect intellectual property rights. If you believe material available through the Services infringes your copyright, contact us using the information below. You may be liable for damages if you materially misrepresent a claim.

These Legal Terms remain in effect while you use the Services. We may deny access, terminate your use, delete your account, or remove content at any time, without warning, if you breach these terms or applicable law.

These Legal Terms are governed by the laws of Bulgaria. If you reside in the EU as a consumer, you additionally have the protection of mandatory provisions of the law in your country of residence.

The parties agree to attempt informal negotiation for at least thirty (30) days before initiating arbitration. Arbitration will be determined by one arbitrator under the Arbitration and Internal Rules of the European Court of Arbitration, with seat in Plovdiv, Bulgaria, and language in English or Bulgarian.

THE SERVICES ARE PROVIDED ON AN AS-IS AND AS-AVAILABLE BASIS. YOUR USE OF THE SERVICES IS AT YOUR SOLE RISK. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

TO THE FULLEST EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR DIRECT, INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFIT, LOST REVENUE, OR LOSS OF DATA. OUR LIABILITY WILL BE LIMITED TO THE AMOUNT PAID, IF ANY, BY YOU TO US DURING THE SIX (6) MONTH PERIOD PRIOR TO THE CAUSE OF ACTION.

You agree to defend, indemnify, and hold us harmless from claims, losses, damages, liabilities, and expenses arising from your use of the Services, breach of these Legal Terms, violation of rights, or harmful acts toward other users.

We maintain certain data for Service performance and account operation. You are responsible for all data you transmit. We are not liable for loss or corruption of such data.

You are strictly prohibited from using automated systems, including robots, spiders, scripts, crawlers, or offline readers, to access the Services. You may not scrape, copy, or extract historical data or backtesting results for any purpose, including machine-learning training or external databases.

You shall not, and shall not permit any third party to, reverse engineer, decompile, disassemble, derive source code or algorithms from, or bypass access restrictions in the backtesting engine or Services.

All historical price data and chart information are provided as-is for educational and backtesting purposes only. We do not warrant that data is accurate, complete, or up-to-date. Technical errors, data gaps, or bad ticks may occur, and we are not liable for trading decisions made from such information.

We may remove any user from the leaderboard or terminate an account if we suspect gaming the system, using scripts to generate fake results, or conduct that undermines community ranking integrity.
